What is the legal process for divorce in Pakistan?
The legal process for divorce in Pakistan is governed by the Muslim Family Laws Ordinance, 1961. A husband who wishes to divorce his wife must provide a written notice to the relevant Union Council. The council then forms an Arbitration Council and initiates a 90-day reconciliation period. If reconciliation fails, the divorce is finalized, and a divorce certificate is issued. A wife can also initiate a divorce, known as a Khula, through the Family Court.
Who gets child custody after a divorce?
The court’s primary concern in child custody cases is always the “welfare of the minor.” While Islamic law often gives the mother custody of a son until age 7 and a daughter until puberty, the court can deviate from this if it is in the child’s best interest. Factors such as the parents’ character, financial stability, and living environment are considered to ensure the child’s well-being is the top priority.
What are Mahr (Dower) and Maintenance?
Mahr (dower) is a mandatory payment of money or property that the husband promises to the wife at the time of marriage. It is the wife’s legal right and can be claimed at any time during the marriage or after divorce. Maintenance refers to the financial support a husband must provide to his wife and children after divorce for a specific period to ensure their financial security.
What is the benefit of arbitration or mediation in family cases?
Arbitration and mediation are alternative dispute resolution methods used to resolve family cases outside of a traditional courtroom. The main benefits are that they are generally faster, more cost-effective, and less stressful than litigation. A neutral third party helps both sides negotiate and reach a mutually agreeable settlement, which often leads to a better long-term relationship between the parties.
